Terms & Conditions

These terms govern access to our website and participation in courses offered by Kamolwan. Please read them carefully before enrolling. If you have any questions, our team is happy to clarify.

1 Definitions

"Service" or "Services"
— the educational courses, course materials, live sessions, and advisory calls provided by Kamolwan.
"We / Us / Our"
— Kamolwan, the course provider, operating from Bangkok, Thailand.
"You / User / Participant"
— any individual who accesses our website, submits an enquiry, or enrols in a course.
"Content"
— all materials, presentations, reference documents, research libraries, and recordings associated with our courses.
"Agreement"
— these Terms & Conditions, together with our Privacy Policy and Cookie Policy.

2 Acceptance of Terms

By using our website or enrolling in a course, you confirm that you have read, understood, and agree to be bound by these terms. If you do not agree, please do not use our services.

Our courses are designed for adults aged 18 and above. By enrolling, you confirm you meet this minimum age requirement and have the legal capacity to enter into an agreement.

These terms are governed by the laws of the Kingdom of Thailand.

3 Service Description

Kamolwan offers structured educational programmes on gold and commodity investing, designed for adults over 40 in Thailand. Our three current programmes are:

  • Understanding Gold as an Asset Class — introductory programme (฿4,800)
  • Diversifying with Commodities Beyond Gold — intermediate programme (฿10,500)
  • Commodity Allocation and Cycle Awareness — advanced programme (฿17,200)

Programme schedules, session formats, and included materials are described on the Solutions page and confirmed at enrolment. We reserve the right to adjust scheduling due to operational needs, with reasonable notice to enrolled participants.

4 Enrolment & Accounts

Enrolment is confirmed upon receipt of payment and a confirmation email from our team. You are responsible for providing accurate contact information at the time of enrolment.

If you are given access to any participant portal or online material library, you are responsible for maintaining the security of your login credentials and for all activity under your account.

Enrolment places are limited per cohort. Confirmed places cannot be transferred to another individual without prior written consent from Kamolwan.

5 User Responsibilities

As a participant, you agree to:

  • Engage with course content and sessions with respect for other participants and facilitators
  • Not record, reproduce, distribute, or resell any course content without written permission
  • Not share access credentials or enrolment places with non-enrolled individuals
  • Not use the course platform or materials for commercial purposes beyond your own personal learning
  • Provide honest and constructive feedback when requested

We reserve the right to remove a participant from a cohort if their conduct materially disrupts the learning environment for others.

6 Intellectual Property

All course content — including written materials, presentations, charts, exercises, reference guides, and recordings — is the intellectual property of Kamolwan or its content partners.

Upon enrolment, you are granted a limited, non-exclusive, non-transferable licence to access and use course materials for your personal educational purposes only. This licence does not include any right to reproduce, redistribute, or create derivative works from our content.

Feedback, suggestions, or ideas you share with us do not create any intellectual property obligation on our part.

7 Payment Terms

All prices are quoted in Thai Baht (฿). Payment is due in full at the time of enrolment unless an alternative payment arrangement has been confirmed in writing by Kamolwan.

Refund Policy

  • Cancellation at least 14 days before the cohort start date: full refund, minus a 5% administrative fee
  • Cancellation between 7 and 13 days before the start date: 50% refund
  • Cancellation fewer than 7 days before start, or after the programme has commenced: no refund
  • If Kamolwan cancels or significantly restructures a programme, participants will receive a full refund or the option to defer to a future cohort

Refund requests must be submitted in writing to [email protected]. Refunds are processed within 14 business days.

8 Course-Specific Terms

Session Attendance

Live sessions are conducted at scheduled times. Recordings may be made available at our discretion, but attendance is encouraged. We cannot guarantee rescheduling for individual participants who miss sessions.

Advisory Calls

Advisory calls included in Programmes 2 and 3 must be scheduled within the programme duration. Unused advisory calls do not carry over or entitle you to a credit.

Research Library Access (Programme 3)

Access to the curated commodity research library is available for the duration of the programme and for 90 days following completion. Library content is updated periodically and subject to change.

Completion

Completion acknowledgement is provided to participants who attend the required sessions and complete exercises. This is an educational recognition and does not constitute a professional certification or licence of any kind.

9 Disclaimers

Important Notice

Kamolwan provides educational content about gold and commodity markets. Nothing presented in our courses constitutes financial advice, investment advice, or a recommendation to buy or sell any financial instrument. All investment decisions remain solely your own responsibility.

Past market patterns discussed in our programmes do not predict future performance. Commodity markets involve risk and participants should seek independent financial advice before making investment decisions.

Our services are provided on an "as available" basis. We make reasonable efforts to deliver sessions and materials as described but do not warrant uninterrupted access or specific learning outcomes.

10 Limitation of Liability

To the fullest extent permitted by Thai law, Kamolwan's liability to you in connection with our services shall not exceed the total amount paid by you for the specific programme giving rise to the claim.

We are not liable for indirect, consequential, or speculative losses, including but not limited to investment losses, loss of profits, or loss of data arising from use of our services or reliance on course content.

11 Indemnification

You agree to indemnify and hold harmless Kamolwan, its team members, and affiliates from any claims, losses, or expenses (including reasonable legal costs) arising from your breach of these terms, your misuse of our services, or any investment decisions made based on course content.

12 Termination

Either party may terminate participation in a programme as described under the refund policy (Section 7) or due to breach of these terms.

Kamolwan reserves the right to suspend or remove a participant without refund if they engage in conduct that is disruptive, abusive, or in violation of these terms.

Upon termination, your licence to access course materials ends. Sections 6, 9, 10, 11, and 13 survive termination of this agreement.

13 Dispute Resolution

These terms are governed by and construed in accordance with the laws of the Kingdom of Thailand. Any dispute arising under these terms shall first be subject to good-faith informal discussion between the parties.

If informal resolution is not achieved within 30 days, disputes shall be submitted to the jurisdiction of the Thai courts in Bangkok.

Consumer rights under the Consumer Protection Act B.E. 2522 and related Thai legislation are not affected by these terms.

14 General Provisions

Entire Agreement. These terms, together with our Privacy Policy and Cookie Policy, constitute the complete agreement between you and Kamolwan regarding use of our services.

Severability. If any provision of these terms is found unenforceable, the remaining provisions continue in full effect.

Waiver. Failure to enforce any right under these terms does not constitute a waiver of that right.

Assignment. You may not assign your rights or obligations under these terms without our prior written consent. We may assign our rights in connection with a business transfer.

15 Changes to Terms

We may update these terms from time to time. When we do, we will revise the "Last updated" date above. For enrolled participants, significant changes will be communicated by email with reasonable notice.

Continued use of our website or participation in courses after any update constitutes acceptance of the revised terms.
